WHO CAN FILE A WRONGFUL DEATH CLAIM IN TEXAS?


Under the Texas Wrongful Death Act, a claim can be brought by the surviving spouse, children (including adult children), and parents of the person who died. Siblings, grandparents, and other relatives generally cannot bring a wrongful death claim. If none of the eligible family members files within three months of the death, the executor or administrator of the estate may file, unless the family asks them not to.

The estate may also bring a separate survival claim for the losses the person suffered before they died, such as their pain and medical expenses. We evaluate both claims in every case.
