Houston Railroad & FELA Lawyer

Houston is one of the busiest rail hubs in the country, with major rail yards, port terminals, and thousands of grade crossings across the region. When a train collides with a vehicle, a pedestrian is struck, or a railroad worker is hurt on the job, the injuries are often devastating, and the railroad’s claims team begins its own investigation right away. Cammack Law Firm represents railroad workers, crossing collision victims, and families who have lost someone in a rail accident. We know the federal rules that govern these cases and prepare every case for trial.

INJURED WORKING FOR A RAILROAD?

Railroad workers are not covered by state workers’ compensation. Instead, the Federal Employers’ Liability Act (FELA) allows injured rail workers to sue the railroad directly. Under FELA, the railroad can be held responsible if its negligence played any part, even the smallest, in causing the injury. Compensation can be reduced if the worker was partly at fault. But when the railroad violated certain federal safety statutes, such as those covering locomotives and safety appliances, the worker’s own fault does not reduce the recovery.

FELA claims generally must be filed within three years of the injury. For occupational injuries and illnesses that develop over time, such as repetitive stress injuries or toxic exposure, the timing rules are more complicated, so it is important to get advice early.

WHAT CAUSES CROSSING ACCIDENTS?

Many crossing collisions are preventable. Common causes include:

  • Malfunctioning or missing gates, lights, and bells
  • Trees, brush, or parked rail cars blocking the view of oncoming trains
  • Failure to sound the horn or excessive train speed
  • Poorly maintained crossing surfaces
  • Inadequate warnings at crossings with a history of accidents

Federal law can limit certain claims about crossing warning devices, so the facts of each crossing matter. We investigate the full history of the crossing, not just the day of the accident.

HOW WE BUILD YOUR CASE

Railroads keep detailed records, and they control most of them. We send preservation demands right away and pursue the locomotive event recorder data, forward-facing video, dispatcher and signal records, crew statements, track and crossing inspection records, and the crossing’s accident history. We work with rail operations experts, accident reconstructionists, and signal engineers to show what the railroad knew and what it should have done.

For crossing and pedestrian accidents, the deadline to file a lawsuit in Texas is generally two years. For rail worker claims under FELA, it is generally three years. Please don’t wait to get advice.
